Medical Transport Driver Files Class Action for Unpaid Overtime & Minimum Wage arising from Off the Clock Work


On July 9, 2024, Frankel Syverson PLLC filed a lawsuit on behalf of Medical Transport Drivers who work for AAA Cab Service, Inc. and MTM Transit LLC, for unpaid wages including unpaid overtime and minimum wage.

In the lawsuit, the lead plaintiff alleges that she was required to work time off the clock as a Medical Transport Driver, including time she was required to work through breaks.  The lead plaintiff alleges that the company required her to deduct time for breaks that she was required to work through, resulting in numerous hours that she was required to work off the clock.  For example, if a Medical Transport Driver worked more than 9 hours, the the lead plaintiff alleges that the company required them to deduct 1 hour for a break regardless of whether they worked that time. If a Medical Transport Driver worked more than 12 hours, the lead plaintiff alleges that the company required them to deduct 1.5 hours for a break regardless of whether they worked during that time. The Medical Transport Driver also alleges that they must work uncompensated time when the company considered them “on call” and when completing tasks such as reviewing manifests to ensure they are ready for the day. When accounting for all the hours the Medical Transport Driver was required to work including time off the clock, the Medical Transport Driver alleges that she frequently earned less than the minimum wage during the typical week and was not paid overtime she was due.
