Tow Truck Driver Files Class Action for Unpaid Overtime, Minimum Wage, and Paid Sick Time Violations


On September 25, 2023, Frankel Syverson PLLC filed a lawsuit on behalf of Tow Truck Drivers who work for Professional Towing and Recovery LLC, for unpaid wages and violation of Arizona’s Paid Sick Time Statute.

In the lawsuit, the lead plaintiff alleges that he was required to work time off the clock as a tow truck driver, including on call time waiting near recent drop offs and completing other duties before and after his shift.  He alleges that he worked as many as sixty to seventy hours per week and many of the hours were unrecorded time he was required to work off the clock.  As a result of all the hours he was required to work, the tow truck driver alleges that he frequently earned less than the minimum wage during the typical week and was not paid overtime he was due.

The tow truck driver also alleges that the company failed to provide notice about Paid Sick Time and allow him to use Paid Sick Time when he was out sick, in violation of Arizona law.  He also alleges that he was not timely paid all his wages due, including commissions.
